Title: CONTESTED VERSUS UNCONTESTED Contested: • Contested divorce occurs when there are disputes between the spouses. • Disputes might include grounds for divorce, property division, child custody and/or support. • A Supreme Court Justice decides the issues after trial requiring testimony of spouses, witnesses, documentary proof & evidence and Court and attorneys’ fees. • Settlement may still be reached before trial avoiding expenses and uncertainty of trial. Uncontested: • Uncontested divorce is one in which both spouses agree on all aspects of the divorce. • Defendant spouse does not ‘appear’ in the Action for Divorce by serving an appropriate legal response. • Uncontested divorce can be finalized without any personal appearances in Court. • Uncontested divorce can be a relatively inexpensive process.
