Title OVERVIEW OF THE MARRIAGE EQUALITY ACT<br >The New York State Marriage Equality Act grants same sex couples the freedom to marry in New York State and prohibits the denial of a marriage license to same sex couples<br >Marriage License<br >Same sex couples who wish to marry in New York State must comply with the same legal requirements applicable to marriages between members of the opposite sex The couple must obtain a marriage license from any town or city clerk in New York State which may be used to get married anywhere in the state Both partners must be present to apply for the license Once the license is obtained the partners must wait 24 hours before the marriage ceremony<br >No Residency Requirement<br >There are three requirements for legal marriage in New York State the presence of both partners one witness and a valid officiant The marriage ceremony must take place within 60 days of obtaining the marriage license New York State does not have residency requirements for being married in the state which allows residents of other states to apply for a marriage license and be married in New York State<br >Access to All Protections<br >Same sex marriages in New York State are automatically entitled to the protections granted to all spouses under state and local laws in New York This includes tax and insurance benefits health care and family leave inheritance rights property ownership and transfer rights parental rights workers compensation and wrongful death claims as well as the use of state and local judicial proceedings related to separation divorce orders of protection and child custody<br >OConnell and Aronowitz understands that LGBTQ families are part of the fabric of our community We are honored to be chosen to represent LGBTQ community members in good times and bad and we are well prepared to meet your needs with experience and compassion<br >VISIT US AT WWWOALAWCOM
