O&A Attorneys Present at NYCQAL Annual Conference

On March 14, 2011, five attorneys of the O’Connell and Aronowitz law firm presented at the annual conference of the New York Coalition for Quality Assisted Living, Inc. (NYCQAL) held in Atlantic City.

Formed in December 2005, NYCQAL is a not-for-profit corporation organized to advocate for the continued viability of adult care, assisted living and other facilities, and to protect and improve the health, safety and quality of life for all residents. NYCQAL members provide care to more than 5,000 individuals and serve as the safety net for many indigent persons with multiple physical and mental disabilities who would not otherwise have a place to call home. NYCQAL is committed to assisting its members deliver high quality care by providing effective member advocacy and representation, continuing education and training.

Jeffrey J. Sherrin spoke about current federal and state court litigation impacting adult care facilities and the health care provider community, including pending federal court challenges to the legality of the federal health care reform law (“PPACA”).

Jane Bello Burke spoke about assisted living programs (ALPs) and the myriad of rules applicable to this modality.

Richard Harrow, a 27-year veteran of the New York State Attorney General’s Office Medicaid Fraud Control Unit (MFCU), recently joined the firm. Mr. Harrow spoke about tactics and strategies used by the MFCU and federal investigatory agencies in conducting criminal investigations of Medicare and Medicaid providers.

A panel discussion followed that featured Mr. Sherrin, Ms. Burke, Mr. Harrow, David Ross (former New York State Acting Medicaid Inspector General), and Kurt Bratten, a litigation attorney who handles many adult home matters. Numerous compliance-related questions from the audience, and hypotheticals from the panel, were discussed and addressed.
