Appellate Law

Our appellate lawyers assist other attorneys, both inside and outside the firm, on all aspects of appellate practice, from notice of appeal to final argument, in state and federal courts. Our appellate attorneys appear frequently before the New York State Court of Appeals and intermediate appellate courts on a wide range of issues. Recently, we were victorious in Healthcare Association of New York State, Inc. v. Pataki, 471 F.3d 87 (2006), in which the U.S. Second Circuit Court of Appeals held that the National Labor Relations Act preempts a state statute restricting employers from spending monies derived from the State to influence union organizing campaigns, to the extent that those monies could not be considered state funds. The United States Supreme Court later adopted a similar rationale with respect to a California statute in Chamber of Commerce v. Brown, --- U.S. ---, 128 S. Ct. 2408 (2008), in which our appellate attorneys submitted an amicus curiae brief on behalf of a number of New York State health care associations.
