Jane Bello Burke is a partner with our Health Law Practice. Ms. Burke focuses on representing health care and long-term care providers in judicial and administrative proceedings. She also represents clients in federal and state courts in a wide variety of matters, with an emphasis on complex federal litigation and challenges to state action.

    Ms. Burke represents health care entities in regulatory matters, including CMS survey and certification, corporate compliance, and fraud and abuse issues. She has had central involvement in the developing law of adult homes in New York, including recent cases establishing the due process rights of adult home operators. Ms. Burke also litigates on behalf of industry organizations representing hospitals, nursing homes and others on significant issues of widespread importance to the organizations' membership. Representative cases include: Mason v. Central Suffolk Hospital, 3 N.Y.3d 343 (N.Y. Nov. 18, 2004); Niagara Mohawk Power Corp. v. Salerno, -- A.D.2d --, 797 N.Y.S.2d 663 (N.Y. App. Div. 4th Dep't. 2005); and Matter of State Police Administrative Disciplinary Hearing on April 27, 2004, 13 A.D.3d 884 (N.Y. App. Div. 3d Dep't Dec. 16, 2004).
